Terms of Service

Please read these Terms of Service carefully before using our Service. By creating an account or using Snagged Marketplace, you agree to be bound by these Terms.

1 – Interpretation and Definitions

1.1 – Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions apply regardless of whether they appear in the singular or plural.

1.2 – Definitions

For the purposes of these Terms of Service: Account means a unique account created for You to access our Service. Application means the software program provided by the Company, named Snagged Marketplace. Buyer refers to users of the Service who place Orders for Goods. Company (also “Snagged,” “We,” “Us,” or “Our”) refers to Snagged Marketplace LLC, 19821 NW 2nd Ave, #203, Miami, FL 33169. Content means any text, images, or information that You upload or make available through the Service. Goods refers to items listed for sale on the Service. Order means a request by a Buyer to purchase Goods. Seller refers to users of the Service who list Goods for sale. Service means the Snagged Marketplace website and Application. Website refers to www.isnaggedit.com You means the individual using the Service, whether as a Buyer or Seller.

3 – Acknowledgment

Snagged Marketplace LLC is a platform and facilitator only. We are not the seller of record. Sellers are solely responsible for their listings, compliance with applicable laws, and payment of taxes. Sellers are solely responsible for reporting, collecting, and remitting any taxes owed on their sales. By using the Service, You confirm You are at least 18 years old. Use of the Service is also subject to our Privacy Policy .

4 – Governing Law and Disputes

These Terms are governed by the laws of Florida, USA. Disputes will be resolved by binding arbitration on an individual basis. Class actions are waived. Small-claims court claims may still be brought. If any provision is found unenforceable, the remaining provisions remain in full effect.

5 – User Accounts

5.1 Account Accuracy – You must provide accurate and complete information.

5.2 Password Security – You are responsible for safeguarding Your password.

5.3 Termination – We may suspend or terminate Your account for violations of these Terms or for any conduct we reasonably believe harms Snagged, other users, or the integrity of the marketplace.

5.4 Account Information – Sellers may be required to provide bank and tax information for payouts.

5.5 Background Checks – We do not conduct formal background checks on users.

5.6 Identity Verification (KYC) – Sellers must complete identity verification through our payment provider (e.g., Stripe) before listing or receiving payouts. Failure to do so may result in suspension or withheld funds.

5.7 Communications Consent – By creating an Account, You consent to receive transactional and promotional communications from Snagged Marketplace LLC. You may opt out of promotional communications at any time.

6 – Content and Listings

6.1 Your Right to Post – You are responsible for the Content you post.

6.2 Content Restrictions – No unlawful, offensive, or infringing Content is allowed.

6.3 Backups – We are not responsible for loss of Content.

6.4 Copyright Infringement – We follow DMCA procedures for takedown requests.

6.5 Restricted Brands & Items – Sellers may not list or resell items purchased from mass-market or “big box” retailers (including Target, Walmart, Old Navy, H&M, Amazon Basics, and similar outlets).

Snagged is exclusively for boutique and specialty children’s brands also known as "boujee brands". Sellers must select a brand from the approved brand list when creating a listing. See approved brands list here. If a brand is not listed, Sellers must request review by emailing brands@isnaggedit.com. If approved, the brand will be added to the brand list. If not approved, the item may not be listed. Sellers are strictly prohibited from misrepresenting the brand of an item.

6.6 Right to Remove Listings – We may remove any listing or content at any time, with or without notice.

6.7 Reviews & Ratings – Reviews must be genuine, transaction-based, and not abusive. We may remove fraudulent, retaliatory, or inappropriate reviews. Sellers may not manipulate reviews or retaliate against buyers.

7 – Orders and Transactions

7.1 Role of Snagged – We facilitate transactions but are not a party to the contract between Buyer and Seller.

7.2 Buyer Information – Buyers must provide accurate payment and shipping details.

7.3 Errors and Inaccuracies – We cannot guarantee all listings are accurate or available.

7.4 Prices and Fees – Fees for use of the Service will be displayed at checkout and may change.

7.5 Payments – Payments are processed by third parties (e.g., Stripe). Their terms also apply.

7.6 Service Fees – Fees are non-refundable once charged.

7.7 Order Modification – Changes require Buyer and Seller agreement.

7.8 Cancellations – All sales are final. Buyers may not cancel Orders once placed. Sellers may cancel only if unable to fulfill.

7.9 Chargebacks – Sellers are responsible for chargebacks unless they provide valid proof of delivery.

7.10 Shipping Requirements – Sellers must ship within 5 calendar days and provide a valid tracking number. Failure may result in withheld payouts, cancellation, or suspension.

7.11 No Circumvention of the Platform – All transactions initiated on Snagged must be completed on Snagged. Off-platform transactions are not protected, and attempts to bypass the platform may result in suspension or termination.

8 – Prohibited Items

The following may not be listed:

  • Counterfeit or replica items

  • Unsafe or recalled baby/children’s products (cribs, car seats, helmets, etc.)

  • Used underwear

  • Hazardous materials or flammables

  • Weapons, drugs, or controlled substances

  • Adult or obscene content

9 – Disclaimer of Warranties & Limitation of Liability

The Service is provided “as is” without warranties. Snagged Marketplace LLC’s liability is limited to the greater of $100 or the total fees paid by You in the last 12 months. We are not liable for indirect, incidental, or consequential damages.

10 – Intellectual Property

Snagged Marketplace LLC retains ownership of all platform IP. Sellers grant us a limited license to display their content on the Service.

11 – Feedback

By submitting suggestions, You grant Snagged a license to use them without restriction.

12 – Changes to Terms

We may modify these Terms at any time. Material changes will be communicated with at least 30 days’ notice. Continued use of the Service constitutes acceptance.

13 – Survival


The following provisions will continue to apply even after your account is suspended, terminated, or you stop using the Service:

  • Seller Obligations (including shipping, chargebacks, taxes, and prohibited items)
  • Fees and Payment Terms
  • Chargebacks and Refund Policies
  • Reviews & Ratings
  • Dispute Resolution and Arbitration Agreement
  • Disclaimer of Warranties & Limitation of Liability
  • Intellectual Property Rights
  • Governing Law
